On Monday, August 31, the Utilities sector fell -1.2% as narrow breadth and sharp declines in California-exposed power providers dragged the group down. Only 35.5% of the sector's stocks finished higher. The exchange-traded fund tracking the sector, Utilities Select Sector SPDR Fund (XLU), dropped -1.2% to close at $42.22, pulled down primarily by Edison International (-23.0%). The catalyst arrived when California state lawmakers advanced compromise legislation that failed to include the comprehensive wildfire-liability protections investors had sought.
Under the revised measure, insurance carriers preserved the ability to seek reimbursement from electric utilities for wildfire claims. That outcome left regional operators vulnerable to substantial ongoing litigation risk, prompting analyst downgrades and heavy selling across the state's power providers. While broader equities faced additional headwind as crude prices climbed, the specific regulatory setback drove the sector's outsized retreat.
Few names found traction during the session. The top gainers inside the sector, CenterPoint Energy Inc (+0.9%) and NiSource Inc (+0.9%), posted only modest advances. Across the broader equity market, 2 of the 11 sectors rose, reflecting defensive weakness rather than an isolated dip. The sector's equal-weighted move of -1.5% fell further than its cap-weighted decline of -1.2%, showing that smaller holdings faced steady selling pressure alongside the headline laggards.
The day's decline extended a weak stretch for the group, pushing XLU to a loss of -4.8% over the past month. That retreat highlights how regulatory and litigation exposure can weigh heavily on the sector despite its traditionally defensive reputation. High-quality companies make up a limited portion of the portfolio, with only 26.8% of the fund's graded weight sitting in companies graded A or B.
